Mozilla Festival Contributor Agreement
We’re delighted that you want to contribute your work to Mozilla Festival (“the Mozilla Festival”). Below are the terms (the “Agreement”) that apply to your contribution to the Mozilla Festival. You agree to this Agreement by (a) indicating acceptance through a checkbox or other method, (b) submitting your Contribution to Mozilla through the Call for Proposals website otherwise, or (c) entering into an agreement to provide your Contribution to the Mozilla Foundation or its subsidiaries (“Mozilla” or “we”) that incorporates this Agreement. If you do not agree to this Agreement, do not submit your Contribution to Mozilla and do not use the Call for Proposals website.

Age Restrictions and Parental Consent
Persons under 18 (or the age of majority in their jurisdiction, if older) (“Minors”) may not submit their Contribution through this website. Parents or legal guardians of Minors may submit Contributions on behalf of their Minors.
By submitting a Contribution on behalf of a Minor or otherwise agreeing to these Terms, you agree to the following:
- You confirm that you are the parent or legal guardian of the Minor on whose behalf you are submitting a Contribution, and that you are authorized to sign this Agreement on behalf of the Minor.
- You freely and voluntarily consent to have your Minor participate in the Mozilla Festival and to have their Contribution(s) used and displayed by Mozilla as described in this Agreement. You agree that you have obtained all necessary permissions (including from your Minor) to grant the rights in the Contribution granted under this Agreement.
- You agree to all of the terms of this Agreement on behalf of yourself and your Minor. “You” or “you” as used throughout this agreement shall refer to you and your Minor.
- You further grant Mozilla the right to use your Minor’s name, voice, image, likeness and any information that you or they provide in the Contribution or any materials you or they submit to Mozilla or Mozilla’s representatives in connection with Mozilla Festival and as further described in this Agreement.
- You understand that the Contribution and any personal information included within or provided in connection with the Contribution (such as your Minor’s voice, image or other identifying information) may be viewed by any Mozilla Festival participant and in some circumstances the general public, and that Mozilla cannot prevent people from recording or otherwise using such information.
- Mozilla Festival events may be recorded (for example, by video, photographic or audio recording) and published for access and use by Mozilla Festival participants or the general public. You may withdraw your consent for Mozilla to use the recording(s) by contacting Mozilla at festival@mozilla.org. Mozilla shall have a reasonable time period after any such request in which to remove the recording(s).
- You understand that Mozilla may collect limited personal information from your Minor to facilitate their participation in the Mozilla Festival and otherwise as described in the Mozilla Festival Event Privacy Policy available at https://www.mozillafestival.org/en/event-privacy-policy/.
- You understand that, to the extent possible, you may have personal information about your child deleted at any time during or after Mozilla Festival has completed; and that you may contact compliance@mozilla.com for further information about how to do so.
Terms
- Contributions to Mozilla Festival.
Mozilla Festival features a variety of contributions from participants, such as artworks, videos, live and recorded sessions such as workshops, skill shares and discussions, related materials such as slides, handouts, and other visual aids, and collaborative projects created during the Mozilla Festival (together, “Contributions”). The Mozilla Festival team will review your proposal and contact you if your Contribution is selected. If Mozilla agrees to include your Contribution as part of the Mozilla Festival, you agree to make the Contribution available to Mozilla, in a format to be agreed with Mozilla, by a set delivery date. It is important that you provide the Contribution on time so that the Mozilla Festival’s production team can include it in the Mozilla Festival
- Use of Registration Information.
2.1 Mozilla may gather certain information from you when you submit your proposal or in connection with your participation in the Mozilla Festival, including your name, contact info, biographical information, a photograph or other depiction of your likeness, a description of your Contribution, any links or external resources you wish to use in connection with your Contribution, and the Contribution itself (together, “Registration Information”).
2.2 Mozilla may use the Registration Information to identify you as the creator of the Contribution, and to advertise and promote the Mozilla Festival and/or your Contribution, including without limitation on Mozilla’s web and social properties, in public advertising, and in the Mozilla Festival scheduling communications. If you do not want your Contribution used to advertise and promote the Mozilla Festival, please contact us at festival@mozilla.org.
2.3 Our Mozilla Festival Privacy Policy describes how we handle information that we receive from you in connection with the Mozilla Festival. To the extent that this Agreement grants Mozilla permission to use Registration Information in ways not included in the Privacy Policy, this Agreement will control.
- Community Participation Guidelines.
3.1 By participating in the Mozilla Festival, you agree to comply with the Mozilla Community Participation Guidelines available at https://www.mozillafestival.org/en/guidelines/. These guidelines apply to participants, facilitators, wranglers, staff, volunteers, vendors, and anyone else involved in making the Mozilla Festival possible. If you do not respect these guidelines, Mozilla may take corrective action, including removing you from the Mozilla Festival, not displaying your Contribution, and prohibiting you from attending this or any future Mozilla Festivals or other Mozilla events. If removed from the Mozilla Festival, you will not receive any refund for tickets purchased.
3.2 In addition, you agree to comply with any guidelines provided by Mozilla regarding your participation, including without limitation guidelines regarding facilitation of sessions or protecting participant privacy or safety.
- Recording of the Mozilla Festival Events.
Mozilla Festival events, including community sessions and participation in public Discord discussions, may be livestreamed or recorded (for example, by video, photographic or audio recording) and published for access and use by the Mozilla Festival participants or the general public. Please turn off your video and microphone on Zoom (or other teleconferencing platform) if you do not wish to be recorded -- we have no practical way to remove audio or video of your participation in a session. Contact us at festival@mozilla.org with any questions about recordings.
- Grant of Rights in Your Contribution.
5.1 Your Reservation of Rights. Except for the rights granted hereunder, you retain all right, title and interest in and to the Contribution, and nothing in this Agreement assigns to Mozilla any of your ownership rights in the Contribution. Nothing in this Agreement shall be construed to prohibit or prevent you from using the Contribution in connection with Your own products or services or otherwise providing, licensing or authorizing use of the Contribution to third parties.
5.2 License. You grant to Mozilla, its affiliates, and its licensees a nonexclusive, worldwide license to copy, use, distribute, publish, publicly display, and publicly perform the Contribution and any Recordings (defined below) (including Your likeness, photograph, name, voice, and biographical information if included in, or provided to Mozilla in connection with, the Contribution or Recordings) during the Term in connection with the Mozilla Festival and otherwise for the purpose of educating the public and promoting Mozilla and its mission to support internet health, including without limitation on Mozilla Channels (as defined below). If the Contribution will be made available to Mozilla through a non-Mozilla website (e.g. you post it on your website or on YouTube or Vimeo), you grant Mozilla the right to display a hyperlink to the Contribution and such website (and any trademarks included in the hyperlink) and/or embed the Contribution on Mozilla Channels. You further give Mozilla, its affiliates, and its licensees permission to livestream and/or record, by audiotape, video, photograph, or otherwise (the “Recordings”) the Contribution, including any materials used in conjunction with the Contribution (such as slides, handouts, and other visual aids). “Mozilla Channels” means in-person events (including any in-person Mozilla Festival events), Mozilla websites, social media, publications (including the Mozilla Festival book), blogs and other communications, and third party platforms utilized by Mozilla (e.g. Zoom).
5.2.1 Attribution. Mozilla will make reasonable efforts, where practical, to include an attribution of the Contribution as your work when it displays the Contribution. Due to practical limitations, Mozilla cannot commit to including attribution of Excerpts included in Compilations (as both terms are defined below in Section 5.5).
5.3 Permissions for Use of Contribution. You agree to license your Contribution in a manner that is compatible with the license(s) under which Mozilla makes material available to the public. Mozilla’s licensing policies are available at [https://foundation.mozilla.org/en/who-we-are/website-licensing/](https://foundation.mozilla.org/en/who-we-are/website-licensing/). Generally, Mozilla utilizes the Creative Commons Attribution 4.0 International License (“CC BY 4.0”), which provides that others may share and adapt the content on the condition that they provide attribution to the creator. For further details of the license, please read the license terms here: https://creativecommons.org/licenses/by/4.0/legalcode. In addition, the licenses in this Agreement include the rights for Mozilla to:
5.3.1 Make your Contribution and any materials included in the Contribution available to Mozilla Festival participants and the public. This can include display at any live or virtual Mozilla Festival event, and in social and other materials promoting MozFest or Mozilla’s mission to promote a healthy internet. It can also include linking to and/or embedding your Contribution on Mozilla Channels if your Contribution is hosted on a non-Mozilla website. While Mozilla will only use your Contribution during the Term (i.e. during the Mozilla Festival and for approximately 18 months thereafter), Contributions will be published under the CC BY 4.0 license and therefore may continue to be used by others, under the terms of that license, on an ongoing basis.
5.3.2 Record and take Excerpts from the Contribution. Mozilla can make photographs or other reproductions of your Contribution and use those reproductions to promote the Mozilla Festival, Mozilla’s mission and/or your Contribution, including by including such reproductions in Compilations (e.g. the Mozilla Festival book or the Mozilla Festival highlights video). Mozilla will only use full recordings during the Mozilla Festival and for 18 months after. Mozilla can use Excerpts from the Contribution indefinitely to promote the Mozilla Festival, your Contribution, and/or Mozilla’s mission to support internet health, and to let the Mozilla Festival participants know about your Contribution (e.g. on scheduling platforms)
5.3.4 Edit and combine Excerpts from your Contribution with other materials to create Compilations (e.g., daily recaps, a Mozilla Festival highlights video, the Mozilla Festival book), which Mozilla may make available to the public indefinitely.
5.3.5 Store and make available to the public any documents or materials created during the Contribution indefinitely (e.g., a collaborative document created during a workshop).
5.3.6 Mozilla will make best efforts to notify you before using your Contribution in any promotional materials for Mozilla beyond promotion of the Mozilla Festival. Such use would likely be related to promotion of initiatives related to Mozilla’s mission of promoting a healthy internet and not promotion of Mozilla’s commercial products.
5.4 Additional Licenses for Video Submissions. The foregoing license includes the rights for Mozilla to stream the Contribution to end users on demand (including by sublicensing its rights to any third party platform utilized by Mozilla), transcode the Contribution (create compressed versions of your video file that are optimized for streaming); and generate stills (i.e., “thumbnails”) from the Contribution to represent the Contribution (or distribute any thumbnail provided by you). You further grant all end users accessing the Contribution the right to stream the Contribution for purposes of viewing the Contribution during the Term. The “Contribution” shall include its title and any description, tags, and other metadata provided to Mozilla.
5.5 Right to Use Excerpts Indefinitely. You grant to Mozilla, its affiliates, and its licensees a nonexclusive, worldwide license (a) to record and retain portions of the Contribution or Recordings (such as video clips, still images, and quotes) (“Excerpts”), (b) combine Excerpts with other material to create final Contribution(s) (“Compilations”), and (c) to copy, use, distribute, publish, publicly display, and publicly perform the Excerpts (including your likeness, photograph, name, voice, and biographical information if included in, or provided to Mozilla in connection with, your Work or Recordings), either on their own or as included in Compilations, indefinitely in connection with the Mozilla Festival and otherwise for the purpose of educating the public and promoting Mozilla and its mission to support internet health, including without limitation on Mozilla Channels.
5.6 No compensation or right of inspection. You understand that you will not be compensated for any of the rights granted in this Agreement, that Mozilla is not obligated to utilize the Contribution or any of the rights granted under this Agreement, and that you have no right to inspect or approve any individual use of the Contribution, provided the Contribution is used in accordance with this Agreement (i.e., for the purposes of the Mozilla Festival and promoting Mozilla’s mission to support internet health). If you would like for your Contribution to no longer be displayed by Mozilla, please contact us at festival@mozilla.org, and we will make all reasonable efforts to remove your Contribution within a reasonable period. Due to practical limitations, Mozilla cannot remove Excerpts from Compilations.
5.7 No Obligation to Store, Display or Provide You with Backup Copies of the Contribution. Mozilla shall have the right, but not the obligation, to store and display Contributions as set forth in this Agreement. Mozilla shall have sole discretion to determine whether or not to display or continue to display the Contribution, and may choose to not display or to cease to display the Contribution at any time without notice or liability. Upon request, Mozilla may make reasonable efforts to provide you with a copy of your Contribution in its possession, but Mozilla shall have no obligation to store or make the Contribution available to you or anyone else for any period of time or at all. Upon request, Mozilla may also make reasonable efforts to provide you with a copy of the Recordings in its possession, but Mozilla shall have no obligation to store or make the Recordings available to you or anyone else for any period of time or at all. Should Mozilla provide you with a copy of the Recordings, or should you procure such Recordings independently as released under the CC BY 4.0 license, such Recordings may be used by you in compliance with the CC BY 4.0 license. If making use of the Recordings, you should not suggest that Mozilla is endorsing any product, service, event, or any other business or personal offering.
5.7.1 Return of Physical Artworks. For clarity, if you provide Mozilla with physical artwork for display at an in-person Mozilla Festival event, Mozilla will, at its option, either return the Contribution to you or provide you access, at a mutually agreed time, to retrieve your Contribution.
5.8 Release. To the greatest extent possible under applicable law, you hereby release Mozilla from any claims that may arise from use of the Contribution, including claims of defamation, invasion of privacy, rights of publicity, moral rights, and copyright. All licenses granted herein are in addition to any other licenses that you may grant (e.g., a Creative Commons license). Nothing in this Agreement shall be deemed a license “condition” applicable to Mozilla; rather, any breach of a term by Mozilla hereof shall give rise to, at most, a claim for breach of contract only.
- Compliance with Third Party Platform Terms.
Mozilla utilizes various third party services, such as teleconferencing services (e.g., Zoom) and whiteboard applications (e.g., Miro) to produce the Mozilla Festival. You agree to comply with all terms governing the use of such services.
- Representations & Warranties.
You represent and warrant that:
7.1 You, and you alone, are the creator and owner of the Contribution and have the necessary rights to grant to Mozilla the rights in the Contribution you are granting under this Agreement;
7.2 the Contribution and its use as contemplated herein will not infringe the copyright, trade secret, or any other intellectual property or other proprietary rights of any third party;
7.3 the Contribution will not be obscene or libelous, or violate the right of privacy or publicity of any third party;
7.4 You have obtained appropriate releases (if necessary) from all persons who appear in the Contribution; and
7.5 With respect to any photograph that you may provide to Mozilla (e.g. to identify you as the creator of the Contribution) (“Photo”), you represent and warrant that you are the copyright owner in the Photo or otherwise have the necessary rights to grant Mozilla the rights granted herein.
- Indemnification.
You indemnify and hold harmless Mozilla and its subsidiaries and their respective affiliates, directors, officers, and employees from and against any actual out-of-pocket expenses (including reasonable attorney’s fees) and any claims, liabilities, damages, and judgments arising out of your breach of any of the terms of this Agreement.
- Term.
9.1 This Agreement commences on the date you accept the Agreement and continues in effect until May 21, 2026 (the “End Date”). The dates for the Mozilla Festival are subject to change, and Mozilla may adjust the End Date by no more than six months by providing notice to you through the contact information you provide when submitting a proposal.
9.2 Section 2 (“Use of Registration Information”), Section 4 (“Recording of the Mozilla Festival Events”), Section 5.3 (“ Permissions for Use of Contribution”), Section 5.5 (“Right to Use Compilations Indefinitely”), Section 5.6 (“No compensation or right of inspection”), Section 5.7 (“No Obligation to Store, Display or Provide You with Backup Copies of the Contribution”), Section 5.8 (“Release”), Section 7 (“Representations and Warranties”), Section 8 (“Indemnification”), Section 9 (“Term”), Section 10 (“Disputes”), and Section 11 (“Miscellaneous”) will survive the termination or expiration of this Agreement.
- Disputes.
In the event of a dispute between You and Mozilla related to this Agreement, You agree that dispute will be resolved through arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association (“AAA”), and the laws of California shall be applied. The award rendered by the arbitrator shall be final and binding on the parties, and judgment may be entered in any court of competent jurisdiction. You and Mozilla will each pay half of the costs and expenses of the arbitration, and the parties will each separately pay their own attorney fees and expenses unless otherwise required by law. Nothing in this Section will prevent either party from applying to a court of competent jurisdiction for equitable or injunctive relief. In any court action at law or equity that is brought by one of the parties to enforce or interpret the provisions of this Agreement, the prevailing party will be entitled to reasonable attorney’s fees, in addition to any other relief to which that party may be entitled.
- Miscellaneous.
This Agreement will be interpreted and enforced in accordance with the laws of the State of California, without reference to conflict of law provisions. You may not assign this Agreement to anyone else without Mozilla’s written consent. This document contains the entire agreement between the parties with respect to its subject matter. The parties agree that any provision of this Agreement that is held invalid shall not affect other provisions of this Agreement and the rest of the Agreement shall remain in force. This Agreement cannot be modified, unless it is in writing and signed by both parties. The failure of Mozilla to demand strict performance of any provision of this Agreement shall not constitute a waiver of any requirement or of the right to demand strict performance in the future.
